Do I have to come back to Nevada County for court?

In almost all misdemeanor DUI cases, no. Under California Penal Code § 977, you can sign a court authorization allowing me to appear on your behalf. I attend the arraignment, pretrial conferences, evidence motions, and resolution hearings for you.

This saves you the enormous financial and personal burden of flying or driving back to the courthouses in Nevada City or Truckee, taking time off work, or explaining absence to an employer.

How a California DUI impacts out-of-state & Nevada drivers

Many visitors assume an out-of-state license shields them from California DMV actions. Unfortunately, that is a dangerous myth:

  • California Privilege Suspension: California cannot physically revoke another state's physical card, but it can suspend your privilege to drive within California borders.
  • The Interstate Driver License Compact: California shares arrest and conviction data with nearly all 50 states (including Nevada). When California enters a DUI suspension, your home state's DMV receives notice and will generally impose equivalent suspensions or penalties on your home license.
  • Nevada Residents & State-Line Arrests: If you live in Reno, Sparks, or Incline Village and were stopped on I-80 near Truckee, Nevada DMV will enforce California's findings once reported. Fighting the charge early in Nevada County is the only way to protect your Nevada driving record.

Do I really need a lawyer for a first DUI if I live far away?

Yes. Handling a case remotely without local counsel often leads to default license suspensions, bench warrants for missed court dates, and harsher penalties that follow you back home.

I live in the Bay Area — which court handles my case?

If you were arrested in western Nevada County (Grass Valley/Nevada City), your case goes to the Nevada City Courthouse on Church Street. If you were stopped on I-80 or near Tahoe/Truckee, it goes to the Truckee Courthouse on Levon Avenue. I practice regularly in both.

Can I complete DUI school or community service near my home?
